Changes to ADEM Implementation of UST Delivery Prohibition

Recent changes to the ADEM underground storage tank (UST) regulations will be effective April 1, 2014. One of the regulatory changes concerns delivery prohibition. Consequently, ADEM’s implementation of the delivery prohibition program will be modified. Delivery prohibition will actually begin when red tags are placed on the fill pipes, rather than beginning on Wednesday at 12:00 am after a facility is placed on the ADEM Delivery Prohibition List.

Many things will remain the same. For example, the Delivery Prohibition List will still be available on the ADEM website at http://adem.alabama.gov/ust/ust_prohibition.cnt. You will also continue to receive email notices of changes to the Delivery Prohibition List. If you are not receiving email notices of the changes, contact Lee Davis at ADEM, 334-271-7759 and provide your email address. All tanks at a facility listed on the Delivery Prohibition List will still be prohibited from receiving fuel deliveries, not just those tanks in violation.

Under these new regulations, when you view the Delivery Prohibition List you will not see a date & time delivery prohibition begins or unique red tag numbers until the red tags are placed on the fill pipes by an ADEM inspector. If you do see the date & time delivery prohibition begins and unique red tag numbers on the list, that means red tags have ALREADY been placed and it is not legal to deliver to any UST at that facility.

Please be aware there will be a brief period of time between when red tags are placed and when the Delivery Prohibition List is updated. This period could last as long as two or three days in some cases. If your drivers see red tags they must know not to deliver! If there is ever a question about the delivery status of a facility, call the number on the red tag 334-270-5655.

ADEM plans to hold a series of five informational meetings to discuss these and other regulatory changes. Three meetings will be held March 18, 20 and 21 at 1:30 pm at the main ADEM office located at 1400 Coliseum Boulevard, Montgomery, AL 36110. Two additional meetings will be held on March 19 at 10:00 am and 1:30 pm at the Pelham Civic Complex located at 500 Ampitheater Road, Pelham, AL.
